Fresno Criminal Lawyer: Do You Know What Domestic Violence Looks Like?
Apr 29, 2018
Domestic violence is looked upon as a serious crime. Even on a misdemeanor offense, a conviction usually necessitates the completion of a 52 week class and results in substantial jail time. But, what is Domestic Violence?
A lot of us think we'd be able to recognize Domestic Violence if we saw it. It's obvious, after all; a woman with a black eye or a split lip, tearfully apologizing for whatever sent her partner over the edge. It's pretty cut and dry... except that stereotypical image is not, necessarily, accurate. Domestic Violence can arise in different shapes and forms.
The Definition of Domestic Violence
Domestic violence has a broad, yet simple, definition. Domestic Violence is a pattern of behavior used by one partner in a relationship to gain or maintain control over another partner.
So what does that mean? It means that yes, a husband beating up his wife when she threatens to leave him is unquestionably Domestic Violence. However, a girlfriend that screams at her boyfriend until he gives in to her demands is also an abusive situation. A lover who relentlessly stalks a partner on social media, inundating them with hurtful messages in order to maintain control or instill a sense of fear is also committing Domestic Violence.
In short, any kind of abusive behavior that's meant to coerce someone you're in a relationship with into acting a certain way, or doing what you tell them to, likely qualifies as a form of Domestic Violence.
However, not all Domestic Violence arises to the level of being criminal behavior. In California, one of the most common charges is a violation of Penal Code section 273.5, which is when a person intentionally injures another person with whom they are married, are cohabitating, in a dating relationship, or have a child together. There are many other charges that may also fall under the umbrella of domestic violence, such as false imprisonment, stalking, criminal threats, etc.
If you find yourself caught up in a Domestic Violence case, then it's important to get representation as soon as possible in order to make sure you have a voice in the proceedings. For more information on how we can help you with your situation, simply contact us today!
