Understanding California DUI Laws

In 2024, California’s legal blood alcohol content (BAC) limit for drivers over 21 remains a .08%. Although there appears to be some information on the internet that the legal limit for DUI’s in California has dropped to a lower level, this information is inaccurate. While many regions worldwide that have adopted stricter standards to deter impaired driving, California continues to study whether a lower level would provide further deterrance.
Repeat DUI offenders do continue to face stiffer penalties, including longer license suspensions and mandatory ignition interlock devices (IIDs) on their vehicles, requiring them to pass a breathalyzer test before starting their car. First-time DUI offenders may also be required to use an IID, as this program has expanded statewide. An IID is strongly encouraged, as the suspension period is shorter with an IID installed, after a conviction, than the period for driving with a restricted “to and from” license. Drunk Driving by underage drivers continue to face a zero-tolerance BAC policy, with added penalties like immediate license suspension and mandatory education programs if caught driving under the influence.
California continues to have a strong focus on DUI prevention, with mandatory education and rehabilitation programs for all DUI offenders aimed at reducing repeat incidents and addressing the underlying causes of impaired driving behavior.
